In force today: normal duty plus 10%

A garment made in India pays two duties when it enters the United States:

  1. The normal US duty (the “column 1 general” rate in the Harmonized Tariff Schedule). It depends on the garment and the fibre. India has no trade agreement with the US, so there is no lower rate.
  2. An extra 10% Section 301 duty on products of India. It has been collected since 12:01 a.m. Eastern time on 24 Julio 2026, on top of the normal duty. It covers garments, and there is no exemption for apparel. A challenge is pending at the US Court of International Trade, but no court order has stopped collection.

The fibre that predominates by weight decides the line, so a polyester dress pays almost twice the normal duty of a cotton one. los US dress duty calculator lists every fabric, and is refreshed from the US International Trade Commission’s tariff schedule three times a week.

Fees on every formal entry

US Customs also charges a Merchandise Processing Fee of 0.3464% of the value (minimum USD 34.58, maximum USD 670.86 per entry, US fiscal year 2027). Ocean shipments also pay a Harbor Maintenance Fee of 0.125%. The US has no import VAT. State sales tax is not collected at the border.

A worked example

Take woven cotton vestidos invoiced at USD 10,000, shipped by sea. US duty is charged on the transaction value, which excludes international freight and insurance, so the customs value is USD 10,000.

Law passed, not yet applied: up to 100%

The Sanctioning Russia and Iran Act of 2026 (Public Law 119-111) was signed on 18 Septiembre 2026. Section 113 directs the President, dentro 30 días (por 18 Octubre 2026), to raise duties “to a rate of up to 100 por ciento” on all goods from countries that are among the top five importers of Russian crude oil or gas and that keep buying after 18 Octubre. The law sets no minimum rate. It allows a national-interest waiver, and the list of countries is recalculated every 180 días.

As of 7 Octubre 2026, no implementing notice naming India had been published in the Federal Register, the tariff schedule or US Customs guidance. Until one is published, this duty does not apply. A buyer planning shipments that land after 18 October should watch for that notice. We will add it here, with its date and rate, when it appears.

Ended

  • The IEEPA “reciprocal” tariff (25% on India) was ended by Executive Order 14389 on 20 Febrero 2026. US Customs stopped collecting it on entries from 24 Febrero 2026.
  • The Russian-oil duty on India (25%) ended on 7 Febrero 2026 by Executive Order 14384.
  • The Section 122 temporary surcharge (10%) ran from 24 Febrero 2026 and expired at 12:01 a.m. EDT on 24 Julio 2026. The Section 301 duty above started the same minute.

Proposed only

The United States and India announced a framework for an interim trade agreement on 6 Febrero 2026. No agreement has been signed, so it changes nothing for garments today.

What this means for a US buyer

  • Budget on normal duty + 10%, plus fees. That is what is collected today.
  • Fabric choice moves the duty more than any current political risk does. A cotton dress pays 18.4% in total and a polyester dress 26%.
  • For goods landing after 18 Octubre 2026, check this page or the Federal Register for a Section 113 notice before you price.
