Customs Valuation and Transaction Value Rules

The Merchandise Processing Fee is calculated on the customs value of imported apparel, which is appraised primarily according to transaction value under 19 CFR 152.103. Transaction value is defined as the price actually paid or payable for the merchandise when sold for exportation to the United States. The term payable covers circumstances where the commercial price has been agreed upon, even if payment has not yet been remitted at the date of importation. Transaction value specifically excludes international C.I.F. composants; therefore, ocean freight and marine insurance charges are excluded from the dutiable customs value.

Under 19 CFR 152.103(b), certain additions must be made to the price actually paid or payable if they are not already included in the commercial invoice price. These additions comprise packing costs incurred by the buyer, selling commissions incurred by the buyer, the apportioned value of any assists supplied directly or indirectly by the buyer, royalties or licence fees that the buyer is required to pay as a condition of sale, and any proceeds of subsequent resale that accrue to the seller. Dutiable assists include production components, matériels, tools, dies, and moulds; cependant, design and engineering work executed within the United States is excluded from assist additions.

Foreign inland transport charges are evaluated under 19 CFR 152.103(un)(5). For ex-factory purchases, foreign inland freight and related inland charges are excluded from the transaction value. For sales other than ex-factory, foreign inland freight charges are included in the transaction value unless they are separately identified on shipping documentation and occur after the merchandise has been sold for export to the United States and placed with a carrier for through shipment on a through bill of lading. Any price rebate or reduction agreed between the buyer and seller after the date of importation is disregarded for customs valuation.
