DDP vs DAP for Garment Shipments: Who Pays Duty and Import VAT

A partir de 8 Outubro 2026, whether you buy garments under DDP or DAP terms, customs duty and import VAT or GST are calculated on the customs value at the border, and you can only reclaim or defer import tax cleanly when your own business is recorded on the customs declaration. On qualifying Indian-origin woven and knitted vestidos, kaftans, skirts and scarves, preferential duty is 0% in the United Kingdom under the UK–India CETA and 0% in Australia under the Australia–Índia, while Germany charges 6.4% para 9.6% under the EU GSP against standard duties of 8% para 12%. Because standard commercial delivery definitions are not set out in customs tax legislation, you should check with your customs broker how DDP or DAP contract terms affect importer-of-record liability for your shipment.

Who accounts for import VAT when a supplier or broker clears your garments

Importers of women’s dresses, kaftans, skirts and scarves often compare arrangements where the supplier arranges for someone to import and deliver the goods (commonly discussed as DDP) with arrangements where the buyer or the buyer’s broker clears customs at destination (commonly discussed as DAP). Where specific contractual obligations under DDP or DAP are not defined by customs authorities, check with your customs broker before agreeing shipping terms.

In the United Kingdom, HM Revenue & Alfândega (HMRC) guia (last updated 16 Junho 2025) allows a UK VAT-registered business to use contabilização do IVA adiada (PVA) to declare and recover import VAT on the same VAT Return rather than paying it upfront at the border, então o custo líquido é nulo. No approval is needed to use PVA for imports into Great Britain from anywhere outside the UK, or into Northern Ireland from outside the UK and EU. Duas condições se aplicam: the imported goods must be for use in your business with the right to dispose of them (usually as the owner), and your UK VAT registration number must be included on the import declaration (where VAT is recorded against your EORI number).

If you buy goods from a supplier who arranges for a person or business to import and deliver the goods for you, HMRC states that you must agree with the supplier how you want to account for import VAT and provide your EORI number. The supplier must give the person or business importing the goods written instructions before they make the import declaration, and you should keep a written record of what you agree. Equally, if a freight forwarder, customs agent, broker or express operator imports goods on your behalf, you must instruct them in writing before the declaration is submitted—you cannot change how import VAT is accounted for once the declaration is lodged. Non-established taxable persons without a UK establishment must appoint someone to deal with customs and instruct them to select PVA and enter the importer’s details as the consignee. Note that consignments over £135 delivered by post through Royal Mail Group (including Parcelforce when not acting as an express operator) cannot use PVA on a VAT Return, and different rules apply to consignments of £135 ou menos.

Duty and import VAT or GST rates in the UK, Germany and Australia

Across the United Kingdom, Germany and Australia, standard and preferential duty rates apply equally to woven dresses (algodão, viscose / Rayon, poliéster, silk and linen) and knitted dresses (algodão, viscose / rayon and polyester), enquanto lenços tecidos carry lower standard rates in Europe and duty-free status in Australia.

Reino Unido (7 Outubro 2026) 12% on woven and knitted dresses; 8% em lenços tecidos (range 8–12%) 0% under UK–Índia CETA (in force since 15 Julho 2026) 20% on adult clothing (roupas infantis têm classificação zero), on customs value plus duty and incidental expenses Contabilidade de IVA adiada (PVA) on the VAT Return with written instructions to broker or supplier; net cost is nil
Alemanha / UE (8 Outubro 2026) 12% on woven and knitted dresses; 8% em lenços tecidos (range 8–12%) 9.6% on dresses and most garments; 6.4% on woven scarves under EU GSP (2026–2028 list) 19% in Germany, charged on customs value plus duty Deducted as input tax on VAT return; Alemanha oferece uma conta de diferimento alfandegário (some EU states use Article 211 permits such as the Netherlands’ Artigo 23 licença)
Austrália (7 Outubro 2026) 5% on woven and knitted dresses; 0% (Free) on scarves, shawls and some knitted lines (range 0–5%) 0% under Australia–Índia (in force since 29 dezembro 2022) 10% GST on the value of the taxable importation (valor aduaneiro, duty, international transport and insurance) Deferred GST scheme for approved monthly electronic BAS lodgers with an ABN; reported and claimed on the next BAS

Na UE, A Índia é um beneficiário padrão do SPG. Although the EU suspended GSP for Indian textiles for 2026–2028, it did not suspend GSP for apparel, so Indian garments continue to receive the 6.4% para 9.6% GSP rate; a renewed GSP regulation applies from 1 Janeiro 2027 and requires a fresh list of suspended sections. Separately, the EU and India concluded negotiations on a Free Trade Agreement on 27 Janeiro 2026, and the European Commission proposed the signing decision to the Council on 11 Setembro 2026. Sobre 5 Outubro 2026, A Tribuna (ANOS) reported remarks by France’s minister for European affairs, Benjamin Haddad, that the deal could remove €4 billion a year in tariffs (the Commission’s estimate of duty savings for EU exporters to India) and double bilateral trade. No entanto, the EU–India agreement is not yet signed and not in force; after signature, the European Parliament must consent and both sides must ratify, with no official entry-into-force date announced. Its draft EU schedule eliminates duty to 0% on every garment line once in force, but under a stricter draft origin rule requiring the fabric to be woven or knitted in India or the EU.

How customs value, transport and origin paperwork affect what is paid at the border

Even when preferential duty is 0%, the customs valuation and freight charges determine the import VAT or GST bill. Under HMRC guidance (last updated 26 Setembro 2025), UK import VAT must be based on the customs value for duty even when no duty is payable, adding any duty plus incidental expenses—commission (excluding buying commission, which is accounted for under the reverse charge procedure), embalagem, transport, seguro, customs clearance charges, quay rent, entry fees, sobreestadia, handling, loading and storage—up to the goods’ first destination in the UK, and to a further UK destination if known at importation. Royalty or licence fees and prompt-payment discounts (if still available at import) may be left out. Importers can calculate UK incidental expenses using Method 1 (actual costs), Method 2 (nationally agreed estimates where international movement terminates in the UK and freight to the UK border is separately distinguished: for airfreight, the greater of 40p per chargeable kilo or £100 mínimo; for surface groupage or consolidation, £90 per gross weight tonne plus £80 per consignment, mínimo £170; for surface full load consignments, £550), or Method 3 (an individual agreement).

Na Austrália, a 10% GST is payable at the same time and in the same manner as customs duty unless the importer is approved by the Australian Taxation Office (ATO) for the Deferred GST scheme (which requires an Australian Business Number, GST registration, monthly electronic Business Activity Statement lodging and payment, electronic dealings with the Australian Border Force, and no outstanding ATO debt or returns). The value of the taxable importation includes international transport and insurance to the port or airport of final destination on the bill of lading or air waybill, or to the Australian address for post and door-to-door courier parcels under 31.5 kgs.

To secure preferential duty at clearance, your customs broker needs the correct proof of origin for each trade agreement:

  • Reino Unido–Índia CETA (0% duty): Garments must originate in India under the agreement’s change of tariff classification and minimum Indian value content rule, supported by an exporter’s origin declaration on the invoice or a certificate of origin issued in India. We issue the certificate of origin for every qualifying shipment.
  • EU GSP in Germany (6.4%–9.6% duty): The exporter must be registered in the EU’s REX system and place a statement on origin on the invoice for your broker to claim the reduced rate.
  • Austrália–Índia (0% duty): Garments must meet the textile origin rule (change of classification plus minimum qualifying value content) and have a certificate of origin obtained from the Indian issuing agency, as there is no self-declaration route (consignments of AUD 1,000 or less do not need one).
